Marketplace software development and support for sales, provenance records, and Certificate of Authenticity services. This includes marketplace platform services, sales support, provenance records, and Certificate of Authenticity (CoA) tooling provided on behalf of artists and authorised sellers.
BuyOneOfOne is not a law firm, tax adviser, insurer, customs broker, or art valuer. Platform guidance is provided to help users operate safely, but buyers and sellers remain responsible for taking their own legal, tax, insurance, and shipping advice.
2. Marketplace Role and Seller Agreement
BuyOneOfOne operates an online marketplace that facilitates transactions between buyers and artists or authorised sellers. BuyOneOfOne is not the seller of artworks listed on the platform and does not take title to artworks offered for sale.
The contract for the sale of artwork is formed directly between the buyer and the artist or authorised seller. Unless applicable law requires otherwise or the buyer and seller agree different written terms, title to the artwork transfers directly from the seller to the buyer and does not pass through BuyOneOfOne.
BuyOneOfOne provides marketplace access, checkout facilitation, payment support, provenance records, order communications, dispute support, and Certificate of Authenticity tooling. These services support the transaction but do not make BuyOneOfOne the artwork seller, owner, importer, exporter, tax adviser, or insurer.
These terms, the seller setup declarations, listing upload confirmations, fee schedule, shipping guidance, return/dispute process, and Certificate of Authenticity terms together form the seller agreement for artists and authorised sellers who list work on BuyOneOfOne.
3. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to register.
4. Listings and Seller Responsibilities
All listed artworks are intended to be unique one-of-one items. Availability and pricing may change before checkout is completed.
Where limited editions are supported, edition runs must not exceed 50 listings in total. Sellers are responsible for ensuring edition numbering, signed status, and edition type are accurate for every listing they publish.
By listing on BuyOneOfOne you confirm that: (a) you are the legal owner or have full rights to sell the work; (b) the listing does not infringe any third-party intellectual property rights; and (c) the work is not prohibited content (including but not limited to illegal, offensive, counterfeit, or hazardous material).
Sellers are solely responsible for the accuracy of their listings, fulfilment of orders, and compliance with applicable laws including export controls and import duties.
Sellers must ensure every title, description, image, video, category, dimension, weight, condition statement, edition detail, framing detail, colour, location, price, shipping origin, and shipping charge accurately represents the specific artwork being offered for sale. Images and videos must show the actual artwork being sold and must not use filters, edits, staging, scale, or omission in a way that materially misleads buyers. If the work is damaged, restored, altered, framed, unframed, signed, unsigned, part of an edition, or subject to any known limitation or provenance concern, the seller must disclose that clearly before sale.
The minimum artwork listing price is £20. Shipping may be offered free of charge. Any paid shipping rate must be at least £5 per destination and should reflect the seller's actual postage, packaging, courier, insurance, and handling requirements.
Sellers must only list lawful goods that are safe to sell, accurately described, and permitted on the platform. Sellers must not list counterfeit works, works they do not have authority to sell, stolen items, hazardous items, or works that breach intellectual property, sanctions, product safety, cultural property, import/export, or other legal requirements.
Sellers are responsible for determining, reporting, and paying any taxes due on their sales, including VAT where applicable. BuyOneOfOne may charge VAT on its platform fees where required by law.
Sellers must tell us whether they are established in the UK or overseas for tax purposes and must provide accurate seller tax information when requested. Online marketplace VAT rules may require BuyOneOfOne to collect, report, or account for VAT in some circumstances, particularly where overseas sellers or imported goods are involved.
During the initial UK launch, BuyOneOfOne may limit seller onboarding to artists and authorised sellers who are genuinely established in the UK and whose listed artworks are located in the UK at the point of sale. For VAT purposes, a UK establishment generally requires real UK business or studio presence; a UK incorporation, registered office, serviced office, virtual office, or mailing address may not be enough by itself. If you are established outside the UK, ship artworks from outside the UK, or list goods that may be imported into the UK for delivery to a buyer, we may require VAT advice, further checks, or restrict checkout before allowing the listing or sale.
Sellers must provide accurate information about their establishment, shipping origin, business status, VAT registration, buyer type, and goods location where requested so BuyOneOfOne can assess whether marketplace VAT rules apply. If the information provided is incomplete, inaccurate, or inconsistent, we may pause listings, require additional evidence, restrict checkout, or collect tax at checkout where we consider it necessary for compliance.
Buyers selecting international delivery may be responsible for import VAT, customs duties, brokerage fees, local taxes, and clearance requirements in the destination country unless the seller, courier, or checkout flow expressly states otherwise. We may require buyers to acknowledge those responsibilities before checkout.
BuyOneOfOne acts as a marketplace facilitator for seller transactions. The seller remains the seller of record, owns the artwork until sale, ships the artwork, and is responsible for returns and product-related obligations. Buyers purchase artworks from the seller, not from BuyOneOfOne.
Sellers are responsible for their own artwork sale obligations, including listing accuracy, lawful sale authority, product safety, consumer information, shipping, returns, seller invoices, VAT or sales tax position, customs paperwork, export or import obligations, and any buyer-facing obligations that apply to their sale.
Our platform fee may include listing access, transaction facilitation, payment support, and documentation services such as Certificate of Authenticity records. Any Certificate of Authenticity is generated and stored by BuyOneOfOne on behalf of the artist or authorised seller. The certificate records the seller's declaration about the artwork, the sale, and the buyer record; it is not an independent appraisal, valuation, or authentication by BuyOneOfOne.
BuyOneOfOne does not judge, value, appraise, or independently authenticate the artwork. We provide the marketplace and record the seller's/artist's claim that the work is authentic. The artist or authorised seller remains responsible for the truth and accuracy of that authenticity claim, the description of the artwork sold, and all listing information.
The confirmation of what is sold and delivered is between the artist or authorised seller and the buyer. The seller must supply the artwork described in the listing and represented in the listing images and videos. The buyer should review the listing before purchase and raise any material mismatch, wrong-item, damage, or authenticity concern through the platform issue process so BuyOneOfOne can preserve records and assist with marketplace review.
5. Payments, Fee Schedule, Receipts, and Invoices
Payments are processed by Stripe. The checkout may show cards, wallets, Link, Amazon Pay, or other eligible Stripe-supported payment methods depending on the buyer's device, region, currency, and Stripe account settings. By purchasing you agree to Stripe's terms of service. We do not store full card, wallet, or payment-method credentials on our servers.
For each completed artwork sale, the artist or authorised seller receives 85% of the artwork or accepted-offer sale price and BuyOneOfOne retains a 15% platform fee. Shipping charged to the buyer is passed on separately and is not included in the 15% platform fee.
| Item | Belongs to | Current treatment |
|---|---|---|
| Artwork sale price | Artist or authorised seller | Seller receives 85%; BuyOneOfOne retains 15% as platform fee. |
| Shipping charged to buyer | Artist or authorised seller | Passed on separately and excluded from the 15% platform fee. |
| Marketplace platform fee | BuyOneOfOne | 15% of the artwork or accepted-offer sale price. |
| Certificate or record service fee | BuyOneOfOne, if separately shown | Currently included in the platform fee unless a separate service fee is expressly displayed before checkout or in this fee schedule. |
BuyOneOfOne's revenue is its platform fee and any separately stated service or Certificate of Authenticity fee. The full artwork sale price and shipping charge are not BuyOneOfOne artwork revenue where BuyOneOfOne is only facilitating the seller's sale.
VAT liability and revenue recognition are separate issues. In some circumstances, online marketplace rules may require BuyOneOfOne to charge, collect, report, or account for VAT on a facilitated artwork sale even though BuyOneOfOne does not own the artwork and does not recognise the full artwork sale price as its own revenue for accounting or corporation tax purposes. The accounting treatment of BuyOneOfOne's revenue remains based on the platform fee and any separately stated service fee, unless applicable law, accounting standards, or professional advice require a different treatment.
Where a seller is genuinely established in the UK and the artwork is located in the UK at the point of sale, the seller will normally be responsible for VAT on the artwork sale if VAT is due. Where an overseas seller, imported consignment, Northern Ireland movement, or UK VAT-registered business buyer is involved, different marketplace VAT rules may apply and we may need additional buyer, seller, goods-location, consignment-value, and VAT-registration information before completing the sale.
Stripe payment receipts and BuyOneOfOne order confirmations are transaction records for the marketplace payment. Unless a document expressly says otherwise, they are not VAT invoices issued by BuyOneOfOne for the artwork itself. The artist or authorised seller is responsible for issuing any seller invoice, VAT invoice, commercial invoice, customs document, or tax record required for the artwork sale.
BuyOneOfOne may create or retain records of its platform fee for accounting, tax, reconciliation, dispute, and compliance purposes. Where required by law, BuyOneOfOne may issue documentation for its own platform fees separately from the seller's artwork sale.
Sellers who receive payments via Stripe Connect must complete Stripe's identity verification before payouts can be made. BuyOneOfOne is not liable for delays caused by incomplete seller onboarding.
We may refuse, pause, refund, cancel, or review a transaction where required for fraud prevention, sanctions compliance, tax compliance, payment security, chargeback handling, anti-money-laundering controls, or platform safety.
6. Consumer Rights and Returns (UK)
If you are a consumer purchasing from a seller located in the UK or EEA, you have the right to cancel your order within 14 days of delivery under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, unless an exemption applies (for example, bespoke or personalised goods).
To exercise your right to cancel, contact us at support@buyoneofone.com within the 14-day window. Refunds will be issued to the original payment method within 14 days of us receiving the returned item in its original condition.
Your statutory rights under the Consumer Rights Act 2015 (goods must be as described, of satisfactory quality, and fit for purpose) are not affected by these terms.
Normal delivery questions should be handled through the order timeline on the website. Issues such as damage, authenticity concerns, wrong item, or not-as-described claims should be reported to BuyOneOfOne first through the order issue process. We may ask the buyer and seller for evidence including photographs, packaging details, tracking records, courier reports, listing images, listing videos, seller descriptions, and provenance information before deciding the next step.
7. Browse and Curation
We use a mixture of curation, category relevance, and rotating browse logic to present artworks. Front-browse ordering may change between visits so exposure is distributed fairly across eligible listings. We may also highlight works based on editorial judgment, user filters, availability, and quality signals.
We do not guarantee continuous priority placement for any listing.
8. Website Messages, Emails, and Records
Order communication between buyers and sellers must take place through the website order timeline. Email notifications are used to alert users that an order update, tracking update, message, or issue request has been posted, but the website timeline is the official order record.
Users must not try to move order disputes, payment requests, refund discussions, or safety issues off-platform. Keeping records on-platform helps BuyOneOfOne review issues fairly and maintain evidence if a dispute, chargeback, fraud review, or legal request arises.
9. Anti-Money Laundering, Sanctions, and High-Value Art
Art transactions can be subject to anti-money-laundering, sanctions, and provenance obligations. If a work of art transaction, or a series of linked transactions, reaches the relevant art market participant threshold, BuyOneOfOne or a seller may need to carry out additional checks, request identity or source-of-funds information, pause the transaction, or refuse the sale.
Users must not use BuyOneOfOne to evade sanctions, launder money, conceal beneficial ownership, misrepresent provenance, split linked transactions to avoid checks, or facilitate tax evasion or other financial crime.
10. Product Safety, Authenticity, and Provenance
Sellers must provide accurate listing information and must disclose known material defects, condition issues, restoration, edition details, provenance concerns, and any restrictions on sale, export, or ownership. Listing images, videos, and written descriptions must match the artwork being sold. Buyers should inspect listing information carefully before purchase and ask questions before ordering where needed.
Certificate records are created from seller-provided information and seller signature details. They document the artist's or authorised seller's certification of the work and BuyOneOfOne's marketplace record of the sale. They do not transfer responsibility for the accuracy of the artwork, listing, or authenticity claim from the seller to BuyOneOfOne.
BuyOneOfOne may remove listings, request evidence, suspend accounts, or cancel transactions where we believe a listing is unsafe, counterfeit, misleading, unlawful, or otherwise unsuitable for the marketplace.
11. Prohibited Conduct
We may suspend accounts or remove listings that:
- Violate applicable law or regulation
- Infringe intellectual property or other third-party rights
- Contain false, misleading, or fraudulent information
- Facilitate money laundering, tax evasion, or other financial crimes
- Violate platform safety or community standards
12. Limitation of Liability
BuyOneOfOne acts as a marketplace facilitator and is not a party to transactions between buyers and sellers. To the extent permitted by law, our liability for any loss arising from use of the platform is limited to the fees received by BuyOneOfOne in the relevant transaction.
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
13. Disputes and Complaints
If you have a complaint about a transaction or our service, contact us first at support@buyoneofone.com. We will aim to respond within 5 business days.
If we are unable to resolve a dispute, consumers in the UK may seek redress through the Citizens Advice consumer helpline or the European Commission's Online Dispute Resolution platform.
14. Changes to These Terms
We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
15. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.
